Terms of Service

1. About these Terms

These Terms are between you and Pastel Alpha (“Pastel,” “we,” “us,” “our”). The “Service” includes joinpastel.com, checkout, dashboard, official Discord community, memberships, calls, scans, research, educational materials, bots, monitors and tools. “Content” includes posts, opinions, alerts, picks, charts, screenshots, performance summaries and automated outputs.

Pastel covers crypto assets, NFTs, stocks, options, sports and esports. Features may include discussion, project news, research, profit and partner tools, monitoring and whitelist opportunities. Your purchase description identifies the access included.

Acceptance requires a process clearly presenting these Terms and an affirmative act of agreement, including checkout, renewal, complimentary-access activation or referral enrollment. Connecting Discord, viewing posts, receiving messages, remaining in the server or accepting Discord’s terms does not itself accept these Terms. Nonmember referrers accept at enrollment; trial, coupon and prize conditions must be disclosed before enrollment or entry.

Existing paid memberships. Eligible existing members keep their purchased prepaid access and accept these Terms at their next purchase or renewal. Declining does not itself cancel remaining access; existing rules and lawful moderation rights continue. An early purchase of a future renewal does not replace the agreement covering a running earlier period.

These Terms govern the accepted new purchase or enrollment. They do not release earlier claims, impose arbitration on pre-acceptance events or validate earlier content uses. An earlier amendment requires a separate, clearly identified valid agreement. Introducing these Terms does not erase earned amounts or promised awards.

The adult-only policy applies from its announced effective date. Confirmed ineligible users cannot continue participating merely because they prepaid, but prior purchase and payment rights remain governed by the applicable arrangement and mandatory law; the policy neither imposes these Terms on an earlier purchase nor authorizes forfeiture.

Accepted purchase commitments and program rules govern their stated subjects without negating express promises or silently replacing Section 13. Separate caller, staff and negotiated partner agreements govern their expressly covered subjects.

2. Eligibility and accounts

2.1 Adults only

Purchasers, enrollees and actual users must be at least 18, meet any higher local age of majority and have contractual capacity. This covers paid and complimentary access, trials, referrals, bounties and giveaways. Adult payment or parental permission creates no exception. Provide truthful information; do not use another identity or account to bypass restrictions or provide ineligible access.

We may securely request reasonably necessary information and restrict access while investigating eligibility. Where reasonably practicable, we will explain how to correct a mistaken restriction. An age declaration is not independent verification or a waiver of mandatory rights. Do not publicly send identity documents or disclose passwords, seed phrases or private keys.

Confirmed age-ineligible users lose community and member-content access and cannot participate while ineligible. This does not automatically forfeit accrued payment or mandatory refund rights; Sections 1 and 5 govern earlier and new purchases. Public legal notices and payment, account or privacy support remain available without claiming adult status.

2.2 Location and activity restrictions

Do not use the Service where unlawful or where applicable sanctions prohibit service or payment, or evade legal, sanctions or platform restrictions. Membership does not establish eligibility to trade, gamble or use partners: any higher activity-specific age and legal or provider conditions still apply, without transferring Pastel’s own obligations to you.

2.3 Discord accounts and security

Discord sign-in authorizes the permissions shown, used to identify your account and administer access and roles. Membership belongs to the purchasing or claiming Discord account and is personal and nontransferable unless expressly permitted. Do not share, sell, rent or give away accounts or access, or use multiple accounts for unauthorized benefits.

Secure accounts and wallets and promptly report compromise. Subject to law, you are responsible for authorized conduct and your own breach of security obligations, not automatically every unauthorized action. This does not excuse Pastel’s misconduct or breach.

3. Memberships pricing and duration

Memberships are prepaid for fixed periods:

A “month” means 30 days, not a calendar month. USDC is a digital asset, not represented as legal tender or guaranteed to retain dollar value. Supported conversions follow Section 4. Prices may change for future purchases; your invoice’s price and purchase terms govern without changing time already purchased.

Start and extension. Membership begins on payment confirmation. Active memberships add new time to the existing period’s end. Check dashboard dates and report errors to support. Leaving Discord or not using access does not pause the period.

Manual renewal. We never charge automatically. Buy again to continue after expiry, when roles and paid access are removed unless valid access credit applies. We may send Discord reminders; checking the end date remains your responsibility.

Coupons and free time. Coupons grant stated days subject to disclosed eligibility, expiry and use limits, once per person per coupon unless its rules allow otherwise. They have no cash value. We may stop future grants or redemption without arbitrarily undoing validly granted days or award commitments. Sections 5–7 govern error, fraud and legal restrictions.

Purchases buy described access, not investment management, guaranteed prizes or results, or recovery of the price.

4. Crypto payments

Use only the invoice’s asset, network and instructions:

Invoices. Invoices last 30 minutes; create a new one rather than initiate payment after expiry. Payment counts after blockchain verification against the invoice. Report payments made within the window but delayed in confirmation or activation with the invoice and transaction hash.

Instructions. Send the correct asset, network, address and any expressly required memo or reference. On Base, send the exact amount including cents, without rounding or deducting gas. Pay network fees separately. Use your own wallet, not exchange withdrawals, swaps, bridges or services that may alter amounts or prevent matching.

Conversion. SOL amounts are fixed at invoice creation. HYPE amounts use the market price when payment is checked, with the tolerance stated in the payment instructions. Review conversion and matching instructions before sending.

Errors. Incorrect assets, networks, addresses, amounts or references can prevent activation and make funds unrecoverable. Blockchain transfers generally cannot be reversed. Recovery from systems or addresses outside our control is not guaranteed; inaccessible-transfer assistance is discretionary except where law requires otherwise. Contact support about mistaken, duplicate, excess, unmatched or delayed payments.

Identifiable duplicate or excess payments received and controlled by Pastel are not automatically forfeited. Verified errors must be addressed consistently with purchase terms, express commitments and mandatory law. Technical irreversibility does not eliminate correction or refund obligations; Section 5 applies.

One transaction, one invoice. Knowingly claiming another person’s payment or multiple credits for one transaction is prohibited and may lead to permanent removal under Section 7. Report good-faith matching errors. We never need wallet secrets or passwords to verify payment.

5. No refunds and payment rights

Purchases are final and non-refundable except where law requires a remedy or Pastel expressly commits otherwise. Changing your mind, nonuse, leaving Discord, unused time, missed opportunities, losing trades or bets, or failing to recover the price do not themselves qualify.

Permitted feature changes or lawful removal for misconduct do not automatically create refund rights, but cannot override purchase commitments or required remedies for nondelivery or breach. This policy does not authorize keeping genuine duplicate or erroneous payments without correction, remove mandatory cancellation rights, or waive ineligible purchasers’ non-waivable rights. A discretionary remedy creates no general refund policy.

To stop future paid access, do not purchase again; there is no recurring charge to cancel. You may still exercise applicable statutory cancellation or other remedies through Section 12.

6. Referrals reputation bounties and giveaways

6.1 Membership referrals

Eligible adults may refer without buying membership. The standard commission is US$60 for an attributed person’s first-ever qualifying paid Pastel membership purchase. Renewals and returning purchasers do not qualify again; prior free trials or gifts alone are not paid purchases.

Apply a valid code in checkout’s shared referral/promotional field. Only one code applies: a referral code cannot combine with a separate promo code, although its own disclosed buyer discount may apply. One referrer receives standard attribution; free time, bounty credits and unpaid transactions earn no standard commission. Report technical errors; an omitted or different chosen code does not guarantee later reassignment.

Codes and links appear on the dashboard. Disclosed tiers or separately accepted partner terms govern different commissions, recurring rights, repeat use and buyer discounts; the standard tier creates no recurring right. Where accepted recurring-tier terms adopt the 30-day attribution window, renewal qualifies only within 30 days after the preceding membership ends. Existing negotiated economic terms control.

Rates and eligibility may change prospectively after notice before affected participation, without cancelling earned commissions or treating genuine offers as mere “examples.” Payments are calculated and paid monthly in the tier’s disclosed supported crypto asset to the saved dashboard Solana address, subject to lawful verification and correction. Cutoffs, payment windows and minimums must be disclosed before applying; these Terms add no fixed 30-day payment hold.

6.2 Promotion and abuse

Disclose commissions alongside promotions. Do not spam, impersonate, fabricate testimonials, guarantee profits, target ineligible users, help bypass restrictions or make unauthorized promises. Advertising and financial-promotion requirements still apply.

Self-referrals through owned or controlled accounts, fabricated purchases, duplicate identities and attribution manipulation are prohibited. A new Discord account does not make an earlier paying customer new. Shared households, funding sources or exchanges alone do not prove abuse.

We may investigate reasonably supported concerns, temporarily hold affected disputed amounts, correct errors, recover amounts affected by fraud or invalid transactions and end future participation. Unrelated bans, lapses or changes do not erase earned commissions. Participation creates no agency, partnership or authority to bind Pastel.

6.3 Reputation bounties

Monthly awards go to the top 10 eligible paid-member recipients based on member up/down reputation votes. Each chooses US$200 or 40 membership days. Callers and staff cannot win.

Reputation is community feedback, not audited expertise or performance. Awards are not based on token returns, ATHs, volume or secret callout metrics, and require no trade, wager or positive promotion.

Period rules must specify eligible voters and recipients, scoring, voting limits, period and time zone, paid-status conditions, ties, review, finalization and delivery. Published criteria cannot change retrospectively simply to choose a different winner. Interim leaderboards remain subject to the disclosed cutoff, integrity review and demonstrable-error correction.

Vote buying, controlled alternate accounts, reciprocal deals, coercion and coordinated dishonest voting are prohibited. Good-faith criticism is not manipulation merely because it lowers a score. Report errors to support.

6.4 Random membership-time giveaways

These are distinct from bounties and commissions; prizes are announced membership time, not cash. Paid-subscriber and nonpaying-member drawings have separate pools; the latter do not provide entry into the former.

Before entry, each drawing needs rules identifying sponsor, eligible locations and ages, actual membership/entry requirements, entry period and limits, selection, winner count, prize duration/value, notification, claim and delivery. These Terms neither replace those rules nor create free entry into paid drawings.

Awarded days are not cash-redeemable at the winner’s choice except by law. Using them requires no extra purchase or automatic renewal. New-prize acceptance conditions must be disclosed before entry. Administration and participation remain subject to law.

6.5 Award and payment administration

Section 2 governs new participation; earlier earned or promised rights follow their applicable rules and mandatory law. We may choose future program periods, but must honor entitlements created by rules or confirmed awards, subject to lawful verification, demonstrable errors, relevant misconduct and legal restrictions—not automatic forfeiture for unrelated bans or lapses.

Provide accurate supported payment details. We may securely request reasonably necessary eligibility, wallet-control or tax information and reasonably hold affected amounts while resolving lawful requests, without arbitrary forfeiture or requesting wallet secrets.

Correct delivery to your designated supported address satisfies delivery, subject to law; sending elsewhere through our error does not. You bear your legally imposed taxes; Pastel retains its reporting, withholding and other obligations.

7. Community access suspension and termination

After confirmation, the Service assigns the member role. Reclaim a missing active role through the dashboard or Discord control, or contact support. Server membership is necessary to access its channels; leaving does not pause time.

We may curate Content and add, change, pause or remove channels, tools, monitors, partners and other features. Unless expressly purchased, no particular feature, contributor, call volume or opportunity is guaranteed. Specific purchase promises and mandatory remedies for material service failure remain.

For lawful reasons—including ineligibility, violations, fraud, security, harassment, disruption or good-faith community-fit decisions—we may restrict features, refuse future purchases, suspend or remove members, immediately without notice where appropriate. We may explain or review restrictions when reasonably appropriate, without guaranteeing timing or outcome unless required by law or express commitment, or revealing sensitive security or others’ information.

Removal creates no automatic refund, subject to Section 5. Bans cannot be used solely to evade payment obligations or punish protected complaints; Section 6 preserves accrued program rights. Discord controls its platform, accounts and availability under its own policies; we cannot guarantee operation or reverse its decisions, without excusing our obligations.

8. Acceptable use

You must not:

  1. Externally share, leak, relay, resell or republish Pastel’s paid research, calls, alerts, tools, bot outputs or others’ paid-channel content without written permission, including screenshots and mirrors.
  2. Share accounts, bypass eligibility or access controls, or use multiple accounts for unauthorized benefits.
  3. Scrape, copy or reverse-engineer protected materials, or use unauthorized automation to bypass controls, extract protected data or overload systems, subject to conduct the law does not permit us to restrict.
  4. Exploit bugs, falsify payments/results, manipulate reputation/rewards or seek unauthorized credit or access. Report bugs to staff.
  5. Harass, threaten, scam, spam, send unsolicited promotions, impersonate others or distribute phishing or malicious links.
  6. Unlawfully infringe rights, expose confidential/sensitive information or engage in fraud, manipulation, money laundering, unlawful wagering or sanctions evasion.

Honest reviews, protected complaints, counsel/authority communications, lawful reporting and non-waivable rights remain protected; good-faith negative reviews incur no fee or forfeiture. This does not allow unlawful disclosure or wholesale redistribution of paid materials.

You retain Section 14 ownership rights, but those do not authorize redistributing combined screenshots or cards containing protected Pastel or third-party material. Obtain written permission where this Section requires it.

9. Content risks conflicts and disclaimers

9.1 Information and independent decisions

Content includes general, time-sensitive buy/sell ideas, stock/options alerts and sports/esports picks. It is not tailored to your circumstances, objectives, portfolio or loss capacity, or personalized investment, legal or tax advice. Scans, informal ideas and researched calls differ; automated alerts may precede investigation. Not every ping is an instruction to buy. Staff roles, confidence labels and reputation do not establish suitability or safety.

Pastel does not manage portfolios, hold investment/betting funds, accept wagers, place your trades/bets, provide copy-trading execution or access accounts to execute transactions. Membership fees are not investment custody. Do not send staff investment capital or execution credentials.

You choose whether to act, how much to risk, platforms and entry/exit timing; consider independent professional advice. Membership creates no appointment as broker, account manager or fiduciary, without overriding duties imposed by law on actual conduct.

9.2 Trading and betting risks

Digital assets, NFTs, securities, options and other speculative instruments can become worthless; leveraged or short positions can lose more than committed. Risks include volatility, illiquidity, fraud, compromised contracts/accounts, liquidation, unavailable exits and platform failure.

Sports/esports picks can lose; odds, lines, availability, settlement, postponements and roster changes affect outcomes. Confidence ratings and “units” are not personalized stakes; Pastel neither settles bets nor guarantees third-party payouts. Meet applicable wagering age, location and operator conditions. Do not arrange unlawful/underage betting or member-to-member wagering, or pressure others to risk money. Risk acknowledgment does not release fraud or non-excludable liability.

9.3 Accuracy and results

Content, prices, odds and calculations may be wrong, incomplete, delayed or outdated. Tools miss events or reproduce third-party errors. We neither verify every submission nor promise updates to every post. Whitelists and third-party opportunities are not guaranteed.

“Scan → Call → ATH” shows selected historical references, not necessarily trades, realized profits or typical results. A scan time need not be a researched-call time; market-cap growth proves neither exit liquidity nor account return.

Profit cards and betting records depend on inputs, timeframe and method. Fees, slippage, costs, voids, pushes, odds and execution affect outcomes. Selected wins are incomplete records; distinguish actual, hypothetical, realized and unrealized results where relevant.

Past results and testimonials do not guarantee future outcomes. Claims require substantiation and relevant qualifications alongside them; generic “not typical” or “not financial advice” labels do not cure misleading impressions.

9.4 Compensation and conflicts

Callers receive fixed pay plus discretionary bonuses that may consider call performance. Pastel pays membership-referral commissions and may receive third-party trading-platform compensation based on activity or fees even without member profits.

Owners, callers, staff and contributors may hold and trade discussed assets, including before posts, at different times/prices. These Terms promise no fixed holding period, blackout or advance notice of every personal trade.

Contributors must clearly disclose material compensation, allocations, project relationships and interests as required by these Terms or law, including nature, source and amount where legally required. Do not conceal positions or relationships misleadingly. Disclosures belong with relevant Content; they authorize no deception, manipulation or unlawful conduct.

9.5 Third parties and warranties

Discord, blockchains, wallets, data providers and partners operate independently under their own terms. Links may earn commissions; trading, derivatives, prediction markets and gambling may be restricted locally. Check eligibility, without relieving Pastel of its duties.

Subject to express commitments and non-waivable rights, Service and Content are “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or non-infringement to the extent law permits. We promise neither profitable decisions, winning bets, uninterrupted service nor error-free tools. These disclaimers do not excuse unlawful conduct or override purchase commitments.

10. Liability and third-party claims

“Pastel Parties” means the Section 1 operator and its owners, personnel and contractors in their Pastel work. Independent members and external platforms are not Pastel representatives merely by appearing in the Service.

To the extent lawful, Pastel Parties exclude indirect, incidental, special and consequential losses, including speculative profits and missed opportunities. They do not insure trades or wagers or owe reimbursement merely because an independent losing decision followed Content. This neither classifies every trading loss as indirect nor excludes liability for proven wrongdoing.

Subject to the exceptions below, combined aggregate liability for Service claims is capped at the greater of US$100 or membership and service fees you paid Pastel in the 12 months before the first event giving rise to the claim.

Exclusions and cap do not apply to fraud, intentional misconduct, gross negligence or liability that cannot lawfully be limited, or reduce required refunds, earned commissions/awards, Section 13 arbitration costs or non-waivable statutory remedies.

To the extent lawful, you reimburse reasonable third-party-claim losses and expenses caused by your material breach, unlawful/infringing submissions or referral promotion, or violation of law or others’ rights in using the Service. Responsibility requires lawful determination or a settlement you consent to, not mere allegations.

This excludes Pastel’s own misconduct or unauthorized/misleading content use, good-faith claims against Pastel, protected reviews/reporting and Pastel’s taxes. Independent losing trades create no indemnity. Pastel must give reasonably prompt notice and reasonable cooperation; you may participate in defense. No settlement may impose payments, admissions or nonmonetary obligations without your consent. There is no automatic duty to fund allegations.

11. Privacy and data

The Privacy Policy at https://www.joinpastel.com/privacy describes website, membership, community and Bot practices, including technical collection, providers, retention and choices. Its Section 3 covers reputation, scans, wallets, profit cards and recaps. The notice is not blanket consent or a substitute for separately required permission.

Service data includes Discord/account access, membership dates/coupons, invoice/blockchain payments, referrals/payouts, programs, support and community content. Public wallets can link to accounts; blockchain records may be permanent and cannot be erased by Pastel. Anonymous card display does not erase associated records; other platforms control their practices and copies.

Section 14 governs reuse and future identifiable-marketing opt-out. Bot /optout addresses future scan mirrors and subsequent recap generation, not deletion of wallets, reputation, existing posts/collages or marketing preferences. Contact Section 12’s email or private support for access, correction, deletion or other privacy requests without paid membership. Mandatory privacy rights and platform restrictions, including Discord API retention rules, control over contractual licenses.

12. Changes applicable law and contact

12.1 Changes and notices

Versions identify effective dates. We notify material changes through website, Discord, email or another appropriate channel and obtain affirmative acceptance where required. Paid members see updates at the next purchase/renewal unless separately and validly agreeing earlier. Continued prepaid use or server presence is not acceptance; Section 1 preserves existing periods, including early future renewals.

Updates cannot retroactively change disputes, erase accrued payment obligations or expand earlier permissions. Section 13 governs arbitration amendments. Notices may use designated contacts or appropriate platforms, subject to legally required methods.

12.2 Applicable law and disputes

Applicable choice-of-law rules determine governing law; the Federal Arbitration Act governs Section 13 where applicable. Covered disputes follow Section 13 and its exceptions; location/format follow that Section and AAA rules. Proper court proceedings require lawful jurisdiction and venue, without an exclusive court location or restricting eligible small claims or permitted arbitration-related applications. Mandatory consumer protections and non-waivable forum or other rights remain.

12.3 General provisions

These Terms and accepted purchase/program terms form the agreement for their subjects. Purchase promises survive general disclaimers; separate staff, caller and partner agreements govern their covered subjects.

Unenforceability leaves the remainder effective where possible, subject to Section 13; non-enforcement or delay does not permanently waive rights. Transfers by you require written permission. Pastel may transfer with a lawful business transfer without reducing accrued rights or mandatory protections. Events beyond reasonable control do not excuse amounts owed or mandatory remedies.

Pastel Parties receive only expressly extended protections and corresponding obligations. Accrued payment obligations, necessary content permissions and applicable dispute provisions survive as their terms provide.

12.4 Contact

For Terms, payment or privacy questions, email privacy@joinpastel.com, use #support at https://discord.gg/pastelalpha, or message @pastelalpha on X. Email works without server access. For private requests, use email or a private ticket with your Discord ID and enough information to identify the issue; never publicly post personal documents or account secrets. Section 13 governs formal dispute notices; these routes do not replace legally required service of court proceedings.

13. Binding individual arbitration and class-action waiver

13.1 Covered disputes and mutual agreement

Except as stated below, you and Pastel agree to resolve by binding individual arbitration disputes arising from these Terms, membership purchases, Content, related representations, access restrictions, program participation or the relationship created by the Service, to the extent lawfully arbitrable. This includes contract, statutory and tort claims.

This agreement is mutual. A Pastel Party seeking its protection must accept its corresponding obligations. It applies to the new purchase or enrollment described in Section 1 following valid acceptance. It does not cover an earlier prepaid period or pre-acceptance events merely because a person later renews. A different retrospective arrangement requires a separate valid, express agreement.

Separate employment or contractor agreements govern their dispute arrangements. This Section is not imposed on a worker’s employment or contractor relationship merely because that person also has a community account.

13.2 Informal resolution

Before starting arbitration, the party raising the dispute must send written notice identifying the relevant account or transaction, the issue and the requested relief. Send notices to Pastel at privacy@joinpastel.com. Pastel will use your designated contact information. Both parties will attempt good-faith resolution for 30 days after receipt. To the extent permitted by law, applicable limitation periods pause during that period. Either party may act to preserve a legal deadline or seek permitted urgent relief. No compulsory in-person meeting is required. This process does not restrict small-claims access, protected reporting or communications with authorities.

13.3 Administrator and rules

The American Arbitration Association (“AAA”) will administer arbitration before one neutral arbitrator under its Consumer Arbitration Rules where applicable, or the otherwise applicable AAA rules, subject to mandatory consumer protections. Rules, forms and fee information are available from AAA at https://www.adr.org/industries/consumer/.

The Federal Arbitration Act governs to the extent applicable. Mandatory law governing arbitrability and required consumer procedures controls over a conflicting term. Where applicable, AAA’s Mass Arbitration Supplementary Rules govern coordinated individual demands; these Terms add no separate batching or waiting scheme.

13.4 Individual proceedings and class-action waiver

To the extent permitted by law, you and Pastel may pursue covered claims only in your own capacities, not as class representatives or class members. Neither party consents to class arbitration or to class, collective or representative proceedings where the waiver is lawful.

Different individuals’ claims may not be combined for a joint merits decision without their written consent after the dispute arises. Administrative coordination under applicable AAA rules does not itself create class arbitration or eliminate individual claims.

13.5 Exceptions and court access

Either party may bring an eligible individual claim in a court with small-claims jurisdiction. Either may seek temporary court relief reasonably needed to preserve the status quo pending arbitration or permitted orders concerning arbitration and an award.

A claim or remedy that applicable law does not permit this agreement to require to be arbitrated remains available in the required forum. Non-waivable rights to public injunctive relief are preserved. Government complaints, investigations, protected reporting and agency proceedings are unrestricted; agencies are not bound by this agreement.

The individual-proceeding restriction applies to court matters only where lawful. These Terms impose no separate blanket jury waiver on claims properly heard in court.

13.6 Fair procedure hearing and remedies

Proceedings may be conducted by video, telephone or documents under the applicable rules or by agreement. A necessary in-person hearing will occur at a reasonably convenient location under the applicable rules. Each party may have counsel, a fair opportunity to present its case and reasonable access to necessary information.

The arbitrator may award remedies available under applicable law for the claim, including statutory relief and attorney’s fees where authorized. Arbitration does not reduce mandatory substantive rights. The written award will state essential findings and conclusions and may be enforced in a court with jurisdiction.

13.7 Fees and expenses

Pastel will pay the business-side administrative fees and arbitrator compensation required by the applicable AAA rules. Consumers will not pay more than those rules and applicable law allow. Pastel will cover additional arbitration costs when necessary to preserve legally required access.

Each party ordinarily pays its own legal expenses, subject to a lawful statutory or other authorized award. A good-faith claim does not itself make you liable for Pastel’s fees. Section 10’s cap does not limit Pastel’s arbitration-payment obligations.

13.8 Formation enforceability and severability

Despite any incorporated rule stating otherwise, a court with jurisdiction decides whether this arbitration agreement was formed and whether this Section or its class-action waiver is enforceable. The arbitrator decides the merits and other matters properly assigned to arbitration.

If the class-action waiver is unenforceable for a particular claim or remedy, that matter proceeds in court as necessary; this does not authorize class arbitration. Remaining claims proceed in arbitration where lawful and practicable. No mandatory delay may extinguish or effectively deny a non-waivable remedy.

Applicable legal claim deadlines remain in place. These Terms do not impose a one-year contractual cutoff.

13.9 Administration failures privacy and changes

If AAA declines or ceases administration under its applicable rules, either party may submit the dispute to an appropriate court as those rules permit. If AAA is otherwise unavailable for reasons unrelated to Pastel’s nonpayment or noncompliance, the parties may agree to an alternative neutral administrator with equivalent mandatory protections or request appropriate court assistance. Pastel cannot use its own default to prevent your claim or defeat rights arising from AAA’s refusal to administer.

Appropriate protective orders may protect private information and trade secrets. There is no blanket prohibition on discussing your experience or communicating with counsel or authorities.

Material changes require valid notice and acceptance where required. They do not apply to a dispute already reported under an earlier version without both parties’ express agreement. This Section survives termination for disputes properly within its scope.

14. Member content public reposting and promotional use

14.1 Ownership and covered posts

You retain ownership of your original submissions. “Community Content” means material you voluntarily post or submit for sharing in Pastel community channels, including paid channels: messages, research, calls, comments, reviews, results, charts, screenshots, photographs, videos, audio uploads and other posts. It includes the display name, username, avatar and other identity elements you attach, to the extent you can authorize their use.

Community Content does not include private direct messages to staff, confidential support or billing tickets, identity-verification documents or payment credentials merely because Pastel receives them. A separate voluntary submission for public sharing can authorize that separate material. This Section does not authorize recording a live voice or video conversation without any required notice or consent.

14.2 Permission to operate and promote Pastel

By validly accepting these Terms, you grant Pastel a worldwide, nonexclusive, royalty-free license to host, store, copy, reproduce, format, crop, excerpt, adapt, translate, distribute, publicly display and publicly perform your Community Content to provide, improve, document and promote Pastel and the Service. This includes public reposts, screenshots, recaps, social-media posts, website features, advertisements and promotional materials, even when the original appeared in a paid channel.

You also authorize use of the username, display name, avatar, and your name, image, voice or likeness included in that Community Content for those purposes, to the extent you have authority to consent. No separate per-post permission or royalty is required for a use within this license.

This license covers future uses after valid acceptance of earlier and later Community Content. It does not retroactively authorize a use made before permission existed or release an earlier claim. Remaining a member without accepting does not grant this license.

Pastel may sublicense these rights to platforms, service providers, editors and promotional partners only as necessary for the described purposes. The license may transfer with the relevant Pastel business, with the recipient bound by its restrictions. It does not permit sale of a member-content database for unrelated purposes or imply endorsement of an unrelated product.

14.3 Limits and other people’s rights

You must have the rights or permissions reasonably necessary for your submission and the rights you grant. Uploading someone else’s work, photograph or screenshot does not grant their copyright, privacy or publicity rights. Pastel must obtain any additional rights needed for its use. Another member’s statements visible in a screenshot are not automatically licensed by the uploader.

Reposting or editing must not materially misrepresent your statement, fabricate an endorsement, remove required disclosures, present hypothetical or unrealized gains as realized profit, or misleadingly imply typical outcomes. This permission does not authorize exposure of confidential information, private keys, passwords, identity documents or other sensitive information appearing incidentally in a post.

The adult-only rule does not establish that every earlier post or depicted person is an adult. Where advertising use of a minor’s identity requires parental or guardian consent, this license does not replace it. A minor’s agreement or inaccurate age statement alone does not establish that permission.

Mandatory privacy rights, consent requirements and applicable platform restrictions remain controlling. A copyright or identity-use license does not independently authorize every processing or disclosure of personal information.

14.4 Future identifiable-marketing opt-out

You may email privacy@joinpastel.com to opt out of new identifiable marketing uses. After receiving and reasonably verifying the request, we will stop creating new promotional uses identifying you within a reasonable processing time. Newly publishing an existing collage or card is a new promotional use for this purpose. Internal service operations and genuinely de-identified use may continue where lawful.

This does not automatically recall material already lawfully distributed, erase independent third-party copies outside our control or require deletion of records we must retain. We will honor any additional withdrawal, removal, erasure or other remedy required by law. Deleting a Discord post or ending membership does not automatically erase existing recaps, notifications, records or distributed material.

The Bot’s /optout concerns future scan mirrors and subsequent recap generation. It is separate from this marketing request and from data deletion. Contact us if you want both preferences applied or want an existing copy reviewed.

Subject to this opt-out, applicable law and the limits above, the license survives termination for Community Content already submitted. It does not transfer ownership or require a positive review or testimonial.

14.5 Pastel materials

Pastel and its licensors retain rights in their original software, branding, research and paid materials. You receive the personal access rights described in your purchase and these Terms. Pastel’s permission to repost Community Content does not give other members permission to relay or resell paid content. Section 8 governs member sharing; Section 11 and the Privacy Policy address data practices and requests.
